1. General
1.1. These Terms and Conditions apply to all quoting, estimates, and work provided by Queensland Property Services Group (QPG) ("the Contractor") to the client ("the Customer").
1.2. By accepting a quote or instructing the Contractor to commence work, the Customer agrees to these Terms and Conditions.
2. Quotes and Estimates
2.1. All quotes are valid for a period of 14 days from the date of issue.
2.2. Quotes are based on a visual inspection and the information provided by the Customer.
2.3. If unforeseen circumstances arise (e.g., hidden water damage, asbestos, or structural issues) once work commences, the Contractor reserves the right to halt work and issue a revised quote for the additional labor and materials.
3. Scope of Work and Legal Limitations
3.1. The Contractor agrees to perform the services detailed in the accepted quote.
3.2. QBCC Compliance: In accordance with Queensland law, unless the Contractor holds a specific QBCC licence, the total value of building work undertaken will not exceed $3,300 (including labor, materials, and GST).
3.3. The Contractor will not undertake any occupational regulated work (such as electrical wiring, gas fitting, or plumbing) unless appropriately licensed to do so.
3.4. Any variations to the original scope of work requested by the Customer must be agreed upon in writing and may incur additional charges.
4. Payment Terms
4.1. Deposits: No upfront deposit is required before the commencement of work, unless specifically stated otherwise in writing for high-cost custom materials.
4.2. Invoicing: Final payment is due strictly within 14 days of the invoice date, following the completion of the work.
4.3. Late Payments: Overdue invoices will incur a late payment fee of 5% per month or part thereof. The Customer is liable for any debt collection or legal costs incurred by the Contractor in recovering unpaid accounts.
5. Customer Obligations
5.1. Access: The Customer must provide clear, safe, and uninterrupted access to the site during agreed working hours.
5.2. Site Preparation: The Customer is responsible for removing fragile items, furniture, and personal belongings from the immediate work area prior to the Contractor's arrival.
5.3. Pets and Children: For safety reasons, the Customer must ensure pets and children are kept away from the work area while work is in progress.
5.4. Utilities: The Customer agrees to provide access to basic utilities such as water, electricity, and toilet facilities necessary to carry out the work.
6. Materials
6.1. All materials supplied by the Contractor remain the property of the Contractor until the invoice is paid in full.
6.2. If the Customer supplies their own materials, the Contractor takes no responsibility for the quality, suitability, or warranty of those specific materials.
7. Warranties and Australian Consumer Law
7.1. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
7.2. The Contractor warrants that all work will be carried out with due care and skill, using appropriate materials, and in a timely manner as required by law.
7.3. No Extended Warranty: No additional commercial or extended workmanship warranty is offered beyond the statutory guarantees provided by the Australian Consumer Law. The Contractor is not liable for general wear and tear, intentional damage, or natural settling/shifting of the property after completion.
8. Liability
8.1. The Contractor holds current Public Liability Insurance.
8.2. While all care is taken, the Contractor accepts no liability for accidental damage to existing structures, plumbing, or electrical wiring that was not reasonably visible or disclosed prior to work commencing.
9. Cancellations
9.1. The Customer must provide at least 48 hours' notice to cancel or reschedule a booked job.
9.2. Cancellations made within 48 hours of the scheduled start time will incur a strict cancellation fee of $50.00 to cover lost time and scheduling impacts, plus the cost of any custom materials already purchased for the job.
10. Dispute Resolution
10.1. If a dispute arises, both parties agree to first attempt to resolve the issue amicably through direct communication.
10.2. These Terms and Conditions are governed by the laws of Queensland, Australia.
